Terms & Conditions: 1) Cancellation. In the event of illness, emergency, or scheduling conflict, please contact me as soon as possible to reschedule. Carol Porta Photography maintains the right to reschedule if needed due to inclement weather, illness, emergency, etc. Requests for rescheduling are granted only at the photographer's discretion. This decision must be made one hour before the event's scheduled start time. 2) Modifications. If the client has a request for a small alteration of an image, please notify the photographer when placing the order. The photographer can address minor changes at no cost (fix blemishes, tighter crop, etc.), but more involved requests are billed at $50/hr. The photographer will notify the client of any extra charges before work begins. Once requested changes are made, charges apply regardless of whether the final product is purchased.3) Product/Image Delivery. The photographer will not begin editing, design work, or process orders until payment is complete. 4) Digital Images. Photographer provides digital files for social media/marketing use and print files free of watermark via download. Images are not to be altered in any way, shape, or form; social media filters are prohibited. Carol Porta Photography offers professional prints at an affordable price that ensures the best print quality, paper, and accurate colors. Altering the images is prohibited. The photographer is not responsible for printing errors or the quality of prints or products printed elsewhere.5) Liability. If the photographer cannot fulfill this Contract due to fire or other casualty, strike, act of God, or other cause beyond the control of the parties, or due to the photographer's illness or emergency, then the photographer shall return any deposit or session fee to the Client but shall have no further liability with respect to the contract. This limitation on liability shall also apply in the event that photographic materials are damaged in processing, lost through camera or media malfunction, lost in the mail, or otherwise lost or damaged without fault on the part of the photographer. In the event the photographer fails to perform for any other reason, the photographer shall not be liable for any amount in excess of the retail value of the client's order. The client releases Carol Porta Photography from all liabilities, claims, and damages that may result from any accidents or incidents that may happen during the event.

SESSION DESCRIPTIONS / RULES Sessions running longer than the appointed time will be billed at $100 per additional hour (1-hour minimum increment). Invoices are provided electronically via email. Event: Official hours of event duration. Private gallery with a minimum of 150 images, available for digital download. A $200 non-refundable retainer is required to reserve your date(s). The remaining balance is due in full no later than 1 day prior to the event date. Failure to submit full payment by this deadline may result in cancellation of services. Files delivered via download.

MODEL RELEASE Host (the individual or entity commissioning this Agreement) commissions Carol Porta Photography to photograph the Event, including attendees, speakers, staff, and activities. Host represents and warrants that it has the authority to grant, and hereby grants, Carol Porta Photography and her legal representatives and assigns the unrestricted right to use and publish photographs taken at the Event for editorial, trade, advertising, and any other purpose, in any manner or medium; to alter the same without restriction; and to copyright the same. Host releases Carol Porta Photography and her legal representatives and assigns from all claims and liability relating to said photographs.Host is responsible for notifying attendees via event signage, registration materials, or other reasonable means that professional photography will occur on-site and that attendance constitutes consent to be photographed. The photographer respects attendees' wishes not to be photographed, or to not have their image shared publicly, when such requests are made known to the photographer directly at the time of the event.

COPYRIGHT Carol Porta Photography retains copyright ownership of all images taken at the Event, as protected under Federal Copyright Law. Host will receive the full gallery of event images and is granted unrestricted usage rights to use, publish, reproduce, and distribute these images for any purpose, including but not limited to marketing, advertising, editorial, social media, and internal use, without additional permission required from the Photographer.This usage grant applies to Host only. Individual attendees who access or download images from the event gallery are permitted personal, non-commercial use only, and may not publish, sell, alter, or use the images commercially without permission from Carol Porta Photography.Unauthorized reproduction by any party outside the terms granted in this Agreement, including but not limited to scanning, downloading, screenshotting, or reposting images beyond permitted use is a violation of Federal Copyright Law and may be subject to civil and criminal penalties.

Signatures. By signing below, you certify that: You are at least 18 years of age. You have read this Agreement/Contract and fully understand its contents. You agree that you have the legal authority to grant these permissions and accept all responsibility for doing so.
